• CIPA — if conduct were determined to violate the California Invasion of Privacy Act, Penal Code §637.2 provides a civil remedy of $5,000 per violation or three times actual damages, whichever is greater. Whether ordinary website analytics fall within CIPA is contested in the California courts, and an automated scan does not determine that a violation occurred.
• Accessibility — UsableNet reported 4,928 federal and state digital-accessibility lawsuits during 2025 (trackers count differently, so figures vary by source). Under ADA Title III a private plaintiff generally seeks injunctive relief and attorney’s fees; civil penalties are available to the government, not private plaintiffs. California’s Unruh Act is the separate route that can carry statutory damages. Reported settlements of $5,000–$25,000 are a market observation, not a statutory penalty.
• The FTC fined accessiBe $1,000,000 in 2025 for claiming its AI widget made sites compliant — and roughly 1 in 5 accessibility suits that year hit sites that already had an overlay installed. A widget is not a defense.
• CalOPPA has no revenue threshold. A privacy policy is required of essentially every commercial site collecting data from California visitors.
• Since January 1, 2026, an opt-out must be visibly confirmed — silent processing no longer complies, and navigating away from a consent pop-up is expressly not consent.
